New York Gun Deal

Believe it or not, the Republican majority Senate in New York State actually passed all of Coumo's gun ban legislation and the other house passed it too. Up until now, I had confidence in the Republicans in Congress holding off the gun grabbing control freaks, but now I am not so sure. I had not written an actual letter to my Representative and Senators in years, but I did today and will have it delivered to their Washington offices by FedEx air. I strongly suggest for all on this forum to do the same. Ask for impeachment of Obama if he bypasses Congress with any new gun laws. Ask your own state representatives to pass laws similar to Wyoming declaring any new Federal gun laws to be unenforceable in their state.

I watched the Assembly live today and the bill sponsor made it clear we can keep 10 round mags but only use 7 rounds in each. Now that's stupid right there but I can keep my 10 rounders anyway.

From the NY law:
For purposes of this subdivision, a large capacity ammunition feeding
device shall not include an ammunition feeding device lawfully possessed
by such person before the effective date of the chapter of the laws of
two thousand thirteen which amended this subdivision, that has a capaci
ty of, or that can be readily restored or converted to accept more than
seven but less than eleven rounds of ammunition, or that was manufac
tured before September thirteenth, nineteen hundred ninety-four, that
has a capacity of, or that can be readily restored or converted to
accept, more than ten rounds of ammunition;

Incredible. As I read this, you can keep your 10 round mags if you own them and your 20 or 30 rounders if purchase prior to 1994. Do you think my Mini-14 mags purchased before 1994 (still in package, never used) are still good? ; )

should be. The way I read the entire bill was if you had mags prior to the ban(2013 ban) that you can keep them but maintain no more than 7 rounds in them

Is there gonna be a "New York Magazine inspector" coming by your house once a month, asking to see your mags and counting the rounds in each one? ha ha ha !!!

Yeah he or she can check my mags but they'll pull back a stump where their hand use to be.

Is there a 'born on date' for magazines?

I will no longer visit the state of NY, nor even travel through it if at all possible.

Some mags do have "born on dates". GI 5.56 30 rounders had date codes before there even was a ban.

During the last ban they had to be marked. NY may require some kind of stupid markings going forward as well. Hopefully not, but they may, just to make it more onerous for manufacturers. I don't think they wrote the language to date yet though.

They did it folks. So here's a short, description of how it works BUT...

Please don't ask me 1000 questions on this, I've read the bill and it causes me fits of laughter, depression and anger, and its typical "bill" language, so it is a freaking awful piece of legal-crap-insanity to wade through without vomiting.

but so far it looks like this to me (and others):

You have one year to comply...
1) If you have a semi auto firearm, then:
a) it cannot have ANY of these features: threaded muzzle, barrel shroud, detachable mag that holds more than 10 ( you may have a 10 and stuff it with 7), pistol grip, collapseable stock,

2) NO person to person sales of ANY firearms
3) If your nasty killing machine has any of the features listed above, you have a year to get rid of it. If you keep it, it must be REGISTERED
4) No grandfathering anything, period
5) A mental health assesment is required for firearm purchases (just for bad guns, I think...)
6) Loop holes have not been felt out yet (ie, such as I own an upper and I own a lower, and they are not attached to each other) but it doesn't look good, because language indicates that if you "own" and AR15" then you are immediately non-compliant, because it "is one" even if you stripped it of all the stuff that makes it kill little kids and butterflies.

I'll fill in as the facts (aint THAT a kick in the head!!) become clearer...

BTW, Bush Masters are made here in NY by Remington. They'll just move, I'm sure. Hey NY kiss EVEN MORE jobs good-bye!

Bushmasters made by Remington?...I always thought the Remington ARs were made by Bushmaster.

BTW, I heard on the radio today that they rushed this stupid bill to the point that it also applies to Law Enforcement...LOL

I thought DPMS @ Bushmaster were purchased by Remington, therefore all these guns are siblings manufactured within the same manufacturer including the camo versioned R15 and R 25 therefore theyre the same guns. I think thats why the Bushmaster dropped the large caliber uppers. Of course i may be mistaken.

They did forget the LEO's but there is an amendment in the works. I work with a bunch of state LEO's and it's been quite a couple of days at work.

Here is the complete text:

http://open.nysenate.gov/legislation/bill/S2230-2013

We can keep 10 round mags but can only put in 7. Higher mags have to go. We can't purchase any gun with a mag over 7 anymore so I am hoping Glock comes out with one. I was going to order a Glock 2 weeks ago but bought a snow blower instead, what a dumb ass.

One of the things that fries my gonads is we cannot transfer any weapon that is classified (except out of state) as a Big Bad Assault rifle. So I can't leave them to my kids in my will.

One of our LEO's ordered one and it didn't come in time now he's screwed, he's pretty pissed.

But our Gov assures us that all the bad guys will turn in their guns so we will be safe in our sleep, what a dumb ass.

The reason they went with 7 instead of 10 was to eliminate the ability to purchase guns they don't like.

This is a clear "infringement" and I hope someone in NY has the courage to file the lawsuit to get those portions of the bill struck down (and keep the part where they can't publish legal gun owners names/addresses without their express permission).

Lawsuit...Constitutionality, and we can knock out CA's, MD's, and every other neo-Stalinist State's law with one stone. They have pushed too far, time to push back harder and win.

Class action is in the works now... c'mon fellow Yankees, pile on.

ericv, you are too kind to the Gov. Dumb would be letting him off the hook. He is a wicked, evil man. He knows well that what he did will have no effect on crime. He will go farther the next time someone with the next version of "evil weapon" (auto shotguns, varmint "snipe" rifle, etc) kills someone.

Additions to be made to gun laws for law enforcement
Thursday, January 17, 2013

Jim Hoffer

NEW YORK (WABC) -- A troubling oversight has been found within New York State's sweeping new gun laws.

The ban on having high-capacity magazines, as it's written, would also include law enforcement officers.

Magazines with more than seven rounds will be illegal under the new law when that part takes effect in March.

As the statute is currently written, it does not exempt law enforcement officers.
Nearly every law enforcement agency in the state carries hand guns that have a 15 round capacity.

A spokesman for the governor's office called Eyewitness News to say, "We are still working out some details of the law and the exemption will be included, currently no police officer is in violation."

The Patrolman's Benevolent Association President released a statement saying, "The PBA is actively working to enact changes to this law that will provide the appropriate exemptions from the law for active and retired law enforcement officers."

State Senator Eric Adams, a former NYPD Captain, told us he's going to push for an amendment next week to exempt police officers from the high-capacity magazine ban. In his words, "You can't give more ammo to the criminals"

Will it include off-duty police officers and their personal weapons? Will it include retired police officers? What legal precedent places the safety of a LEO higher than a standard issue human being?

We need New York Police against gun laws to speak up.
