1. Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background check system. - The background check currently uses the information contained in the National Crime Information Center, the Interstate Identification Index, and/or the NICS Index. Not sure what other data he is talking about.
2. Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system. - This is currently not allowed under the provision added into the ACA by Harry Reid. This will have to go through Congress to be changed.
3. Improve incentives for states to share information with the background check system. - Every State I am aware of utilizes and contributes arrest/conviction data to NCIC. Not sure what he is looking for.
4. Direct the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks. - Whose criteria determines the categories for change? Will male, white, Christians or Veterans get rolled into some category?
5. Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun. - This is handled by State Law and Department Policy. CCH has run a check on anybody arrested or anyone claiming any seized property.
6. Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers. - FFL's already do NICS checks on any private seller transferring a firearm through them. There is currently no law to make all private FTF sellers have a NICS check done. A new law would need to go through Congress.
7. Launch a national safe and responsible gun ownership campaign. - The NRA already does this. Why doesn't he provide funding to the NRA to help them? It would be much more cost effective then to create something from scratch.
8. Review safety standards for gun locks and gun safes (Consumer Product Safety Commission). - The CPSC created the safety standards in the first place.
9. Issue a Presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations. - They should have been doing this all along and it is his agencies that failed to do so.
10. Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement. - NCIC contains a database of stolen weapons.
11. Nominate an ATF director. - This was his responsibility and he has failed to do so. Where was his priority then?
12. Provide law enforcement, first responders, and school officials with proper training for active shooter situations. - Law Enforcement already has this training, as do First Responders. The NRA has offered FREE training to them as well as School Officials and was ridiculed by him and the left. So now it is a good idea because he says it?
13. Maximize enforcement efforts to prevent gun violence and prosecute gun crime. - This is a failure of his agencies and he should have been pushing this all along.
14. Issue a Presidential Memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence. - This will need to go through Congress since I believe they are currently forbidden to collect such data..
15. Direct the Attorney General to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to develop innovative technologies. - This is nothing but a space filler to make it seem like he is doing more then he is.
16. Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes. - The ACA forbids collecting this data, Doctors can ask anything they want, and you would be a fool to tell them.
17. Release a letter to health care providers clarifying that no federal law prohibits them from reporting threats of violence to law enforcement authorities. - HIPAA prevents the release of PHI data.
18. Provide incentives for schools to hire school resource officers.- The NRA pushed for this and was ridiculed by both him and the left. Now it is a good idea since he says it?
19. Develop model emergency response plans for schools, houses of worship and institutions of higher education. - This needs to be done at the State and local level, no two schools are the same and every situation is different. Every State should create a baseline, which most already have done, for LEO and FR training.
20. Release a letter to state health officials clarifying the scope of mental health services that Medicaid plans must cover. - Send a letter, but don't provide the funding required. What a great idea.
21. Finalize regulations clarifying essential health benefits and parity requirements within ACA exchanges. - This was spelled out in the ACA. Is he saying that even he knows it was a bad idea and needs to be fixed?
22. Commit to finalizing mental health parity regulations. - His agencies, his fail again. Where has he been for 4 years?
23. Launch a national dialogue led by Secretaries Sebelius and Duncan on mental health. - When all else fails, form a committee to talk about it.
