Pre Ban Lower

So, I wasn’t sure where to post this question. But i figured the hord members in the NFA section mite has some insite. But feel free to move it if it belongs in a different area.

I discovered that one of my AR lowers is a “Pre-Ban” it’s an old PWA Commando with a very low serial number. I live in Oregon, so it’s just an old lower to me and not any more special to me than others. But some people are telling me that it is very sought after in other states and could be worth some money.

I’m not at all familiar with other states regulations. Who would be interested in this? Californians?
And I’m assuming i could ship it through an FFL to an FFL in another state completely legal?
Sorry for my ignorance, but if anyone could elaborate on any of this it would be much appreciated.

Ask the Oracle, and skim the Gunbroker and other firearm auction sites for average resale.You could ship it to any FFL for legal transfer. Legality state by state however....lot of states don't care when a thing was made. Mostly ownership at the time of the law being put into effect it the key, and even then it won't matter.

Connecticut is where it is worth more.

Maybe NY state too. Laws are constantly changing, but you used to be able to get $800 for pre-ban lowers sold to CT or NY.

Looks like prices have gone up to $1000 or more.

I don't know that it would make any difference in NY now. The un-SAFE ACT doesn't care when, where, how. They are all bad.

Pre-ban usually is referring to the Clinton Assault Weapons Ban of 1994, which created a lot of sales in the industry for existing AR15s and lowers especially. Anything manufactured before the date of effect for the 1994 AWB was considered "Pre-ban", meaning you could still have the features they didn't want you to have, like bayonet lugs, threaded muzzles with flash hiders, and telescoping stocks.

Same for magazines. Anything over 10rd capacity was banned, so magazines made before the ban jumped in price overnight.

1986 FOPA legislation included the Hughes Amendment, which was slapped on at the last minute by Congressrats to a protective piece of legislation for FFLs. The Hughes Amendment banned the new manufacture of machine-guns for private citizen purchase, and therefore grandfathered all registered NFA machineguns up to that point. FOPA came up because ATF was harassing and abusing FFL holders by tricking them into technical violations so they could pull their FFLs, or coerce them into surrendering their FFLs, and it came up in the Senate after an investigation into those ATF abuses.

1986 FOPA also specified the protection of rights of passage between States, and Prohibited a firearms registry outside of NFA.

1934 National Firearms Act (modified the 2A to no longer allow possession or sales of SBRs, SBSs, Machineguns, Destructive Devices (cannons/mortars/artillery), and Silencers without paying a $200 Tax Stamp and being subject to unusual and excessive scrutiny to exercise basic rights previously enjoyed in the US)

1968 Gun Control Act, which banned interstate mail order sales in reaction to the claims that a mail order rifle was used to assassinate President Kennedy 5 years prior.

1986 FOPA Firearms Owners Protection Act and Hughes Amendment

1989 Semi Auto Importation Ban George H.W. Bush Ban on Imported Semi-Automatic Firearms under a "Sporting Purposes" clause in the 1968 GCA

1994 Assault Weapons Ban, which banned combinations of features on semi-automatic firearms, to include bayonet lugs, flash suppressors, standard capacity magazines, and telescoping or folding stocks

2008 Heller vs DC: Reaffirmed an individual's right to keep and bear arms for personal protection in the home, negating local city ordnances or laws to the contrary.
