I don't like speaking ill of the dead. Suffice it to say, it's probably a good thing political comments are not compliant to the forum rules. She surely has been the most political SC justice of my lifetime. Proof can be found by reading her opinions.

It seems to me, these election results are going to be challenged in the courts, no matter who wins.

Two days ago, John Roberts would have likely been the swing vote. Don’t think it takes much imagination to guess how that would turn out.

If Justice Ginsbergs seat remains vacant until the next President is sworn in, and the SC is deadlocked 4-4. The “decision” is then kicked back down to the previous lower courts ruling. So, we could in effect, have the next President of these United States decided by 3 federal judges, presumably, in the 4th circuit?

Is that right?

Very true. Democrats will do whatever they want to keep or gain power, regardless of what Trump does, and regardless of what impact it has on the U.S. The problem with many Republicans in the past has been their weak-kneed responses to Democrat threats.

Thanks, Montana, for the article link. I, too, wanted to be reassured that ACB was a fire-breathing Constitutional Originalist and not another wishy-washy like Kennedy, Breyer, Scouter — and the article did just that.

If nominated to the Supreme Court, Amy Coney Barrett has my approval.

Sorry that she's dead. I didn't agree with her very often, but I respected her legal knowledge and obvious love of the law. I always figured that if she hadn't been worthwhile, Scalia would not have had her as a close personal friend.

Anyway, now that it looks like ACB will be put on the court, does anyone know if there are any upcoming SA cases in the works?
