The part that bothers me most, is that they call the mob peaceful protesters, when in reality, they are trespassers. That was a gated community, was it not? If you see a large mob trespassing in front of your home who look threatening and are shouting verbal threats, you should arm yourself and prepare to use deadly force.
The reason Kimberly gardener wants to prosecute is because she is a liberal democrat funded by George Soros.

Prosecuting them is pretty pretty on that DA's part. Would never happen in most rural counties, at least in our parts.
It's a good argument for jury nullification when DA's go rogue against 2A. It sure would be wise for the McCloskeys to take some firearms classes though. That might be a good outcome. It sure appeared they were sweeping each other.

FLshooter Wrote:If you see a large mob trespassing in front of your home who look threatening and are shouting verbal threats, you should arm yourself and prepare to use deadly force. It was certainly prudent of the McCloskeys to arm themselves, but they did so well before the alleged verbal threats happened -- if they actually happened. Pretty much everything else that the McCloskeys did was (IMO) quite imprudent, and not only escalated the situation, but led to their current legal problem.

The people who entered that gated community knew it was a gated community.Does not matter whether the gates are locked or not,it was trespassing. And if you saw a mob illegally trespassing in a private community, youre telling me you wouldnt grab a gun?If that was a peaceful protest it wouldve been done outside of the gates. Once they tresspassed they were no longer protesters, they were rioters. And thats the main part thats being overlooked by idiot liberals.

So if an individual enters your unlocked dwelling uninvited, proceeds to sit in your recliner, drink your beer and eat your popcorn while watching HBO no crime has been committed. Obviously not because your a privileged person with to much luxury stuff the poor soul who moved in doesnt possess. It doesnt matter how you obtained your possessions because you trampled on someone else to get them. It is very clear to me what is going on here.
This is our future if people dont wake up. Elections have consequences.

None of the protesters entered the McCloskey residence, sat in their recliner, drank their beer and ate their popcorn while watching HBO. Scenes like this are likely why they're in trouble.

Missouri Gov. Parson has suggested a pardon if McCloskys are charged.

Does castle doctrine apply to protecting gated communities? I don't think so.
My understanding of Missouri castle doctrine law is that is pertains to intruders in your home, not trespassers on your land or in your community. The BLM folks did not appear to gain entry or attempt to gain entry into the McClosky home.

Montana is one of several states to abide by the castle doctrine. ... States that follow stand your ground laws impose no duty for a person to retreat from a threatening situation before resorting to deadly force. A person may use force to defend him or herself regardless of where he or she is at the time of the threat.

After all, it isn't like they haven't repeatedly had legal issues in the past, some of which involved their property. https://www.stltoday.com/news/local/metr...dd287.html

To turn a phrase "Live by the law, die by the law."
I'm very interested in seeing how this plays out. I personally don't think what they did was smart. As to whether it was legal, well, it will be a while before we have the answer to that question.

Missouri, stand your ground law: if you have the right to be in a specific location, you have the right to defend yourself or anyone else in serious danger. ... Generally, stand your ground laws give people the legal right to defend themselves and anyone else who is in mortal danger as long as they have a legal right to be in the area. From the hit piece, all I could discern is the McClosky's know how to use the legal system.. I would gather any good lawyer would understand such things.. Looks like they won more cases than they lost..Guilt is not based on popularity. For example, only a judge can order an eviction and it has to be done legally following state and federal law.. Entering a gated community without permission is still trespassing, and considering the general mayhem being perpetrated across the nation by violent leftist, their concern was quite understandable....https://www.foxnews.com/us/missouri-gove...key-couple

What I got from the fact-filled article that you denigrate as a "hit piece" is that the McCloskeys are dishonest, vicious, vindictive individuals who misuse the legal system to try to punish people, and to try to steal things that don't belong to them.

Popeye212 Wrote:This should pretty much give reason.Fake news. Contrary to the article, the McCloskeys "drew their own guns" long before the alleged threats could have happened.* And as can be clearly seen at 0:20-0:24 in the video below, the gate had no visible damage when the protesters were entering. I wouldn't be the least surprised if McCloskey broke down the gate at some time after the confrontation, to help support his lies. *You and others have claimed that verbal threats to kill the McCloskeys can be heard on video of the incident, but when asked to link to video(s) where such threats are discernible, all I get are crickets.

Like I said, popularity is not a judgment for guilt. If they were dishonest, then they would have been charged, found guilty and punished. People are innocent until proven guilty. If they were found guilty of misusing the legal system, then they would have been charged, found guilty and sentenced. Since neither of them has lost their law license, I would say you are guilty of defamation of character. Until then, "your opinion is just conjecture" which means nothing.. The leftist who are burning, assaulting, trespassing and vandalizing are not using the legal system, but are using terror tactics for political gain. There is plenty of evidence to say that...Since neither of us were there as a witness, we will have to see if the DA will find a crime to charge them with and wait to see if they are found guilty...By the way, the mob was trespassing, "which is a criminal offence" and you conveniently never mention...

The protesters in the McCloskey case did not vandalize or burn any property, nor did they physically assault anyone. montana Wrote:By the way, the mob was trespassing, "which is a criminal offence" and you conveniently never mention...LOL. I swear, if this were the 1770s, you and some others in gun forums would be loyalists. I can just imagine what y'all would've been saying in late December, 1773: "Hey, have you heard what that Sons of Liberty group did last week?" "I heard they trespassed onto a ship in the harbor, and threw more than 300 chests of tea into the water!" "They're a bunch of seditious criminals, thugs, and vandals with no respect for the property of other folks." "Well, if they come to my neighborhood, I'll be ready for them with both barrels of my fowling piece loaded with a full charge of buckshot!"
