Constitutional Carry has gotten even closer to being a reality in WV. It's passed the Senate and cleared the House Judiciary. If anyone reading this board is from WV (this means you lurkers too!!! ), then you need to contact your state delegates ASAP! Both call and email if you can. Tell them to support "SB347" Constitutional Carry!!!

3-22 Carry (SB347) Passes House Judiciary
WVCDL members and supporters, thanks to your efforts, 3-22 (constitutional or permitless) carry has passed a major legislative hurdle. It passed the House Judiciary Committee today by a vote of 21-3.

Multiple amendments designed to poison the bill were shot down on 16-8 votes.

The bill is a committee substitute, and there are some changes from the senate version. So I will provide a summary of the bill as it stands now.

If the bill passes in its current form:

- The CHL licensing system remains completely intact so that we may take advantage of reciprocity agreements and carry in other states.

- Anyone over the age of 21 may carry openly or concealed without paying fees and obtaining a Concealed Handgun License, provided they are not prohibited from owning firearms.

- Anyone over the age of 18 who is a member of the Armed Forces, Armed Forces Reserves, or National Guard may carry openly or concealed without paying fees and obtaining a Concealed Handgun License

- The prohibitions of openly carrying a loaded handgun in a car, or in the woods of the state are removed. This will now be permissible without the "gotchas" in the Natural Resources laws.

- A longarm will be considered unloaded in a vehicle (thus legal) as long as the magazine is removed, and the chamber is clear. Meaning, you can't be charged with poaching for having a detached mag with some rounds in it.

- If a sheriff wrongfully denies your CHL, you may obtain reasonable court costs and fees if you take your appeal to Circuit Court and win your case.

- If you move to another county, the Sheriff must issue you a new CHL with your new license, and your original expiration date for a fee of $5.00

This bill is a HUGE win for West Virginians if we can get it to the governor in its current form. Stay tuned as it heads for a vote on the floor of the House.

First reading in the House was yesterday (the 10th), and second reading is scheduled for today (11th). Things are still looking great, but we are nervous and very aware of the possibility of treachery via ammendment. It was tried before and mostly got smacked down. Now we have to watch it like a hawk and keep the heat on.

SB347 is facing multiple attacks, including an amendment by Republican Majority Leader Daryl Cowles, which is intended to kill the bill. Daryl Cowles signed ink on paper, signing his name in a pledge not only to support, but to sponsor a constitutional carry bill.

Now he attempts to kill it.

Daryl Cowles lied to you to get elected. And now he's attacking your rights. His utter lack of integrity has been exposed in his attack on your liberty.

We need as many as can be there tonight. Show the House of Delegates that the people of West Virginia care about their rights.

Constitutional Carry - THANK YOU!!
This evening in the House, SB347 withstood attacks from multiple delegates in the form of bill-killing amendments. The most egregious of which was from the Republican Majority Leader, Daryl Cowles, who pledged in writing to support and sponsor Constitutional Carry.

The bill survived his treachery!

The bill remains unchanged, and should be scheduled for a vote tomorrow.

Why?

Because with less than an hour's notice, YOU packed the House galleries, and lit up your representatives phones and email boxes.

WVCDL, you are a large group of truly incredible West Virginians.

We anticipate a favorable vote tomorrow. We're far from done yet. But a MAJOR hurdle has been cleared thanks, once again, to the incredible activism of West Virginians who care deeply about their liberty!

In the interest of giving due credit, it is very much worth noting that the NRA-ILA lobbyist was working the floor tirelessly this evening. And the NRA does wield major influence in West Virginia. The things we can do when we all pull the same rope....

3-22 Carry Passes the House.
Thanks to your tireless efforts, Constitutional Carry (3-22 carry) has passed the House of Delegates by a vote of 71 - 29.

This historic vote is an enormous leap forward for Second Amendment rights in West Virginia. The stage is set for us to become the 5th state to formally adopt the motto, "the Constitution is my carry permit."

Along those lines, thanks to Delegate Michael Folk for his excellent description of the bill on the House floor. Delegate Folk invoked April 19th 1775, General Gage, Colonel Smith, and Major Pitcairn in his floor discussion. If you don't understand those references, please research.

There are two steps left on this bill. It must re-pass the senate in its amended form. We are expecting that to go smoothly, but will verify this evening or tomorrow.

Then the bill has one final hurdle. The governor must not veto this bill. Please call Governor Tomblin's office at 304.558.2000 and urge him to sign this giant leap forward in the liberty and personal safety of all West Virginians. Contact all your friends and associates, and ask them to do the same. It's not much in terms of effort. Just dial the number, and ask whoever answers, "Please ask the governor to sign SB347."

There's been some progress here with Judges in certain counties ruling that a concealed carry permit process with interview is unconstitutional but the state as a whole has not changed. All we can do is keep trying! Until I move to another state

Good luck in the People's Republic. You have a stronger stomach than me to be able to suffer their crap! Hooefully you can get it rolled back somehow.

I'm not sure on the veto part. We might be able to override him though. Time will tell.

In a news release Thursday, Manchin noted that he is a member of the National Rifle Association and considers himself an advocate of the Second Amendment. However, Manchin said allowing a person to carry a concealed weapon without a permit or training is "irresponsible" and "dangerous."

"There is not one West Virginian whose Second Amendment rights will be infringed without this bill. With the right to bear arms comes the responsibility to use it in a safe and reasonable manner," Manchin said in the Thursday news release.

"In West Virginia, we believe in gun sense, which is common sense, and it only makes common sense for concealed carry applicants to receive proper training. I commend the brave legislators who voted no and represented their constituents who know that this is irresponsible. I strongly oppose Senate Bill 347.”

Maybe we need training and licensing on how to not incriminate ourselves when being questioned? It's only common sense, and we're not really infringing on people's rights by requiring them to get properly trained according to government standards on how to use their rights covered in the Bill of Rights.

SB347 on the Governor's Desk
Anti-gun New York Billionaire Michael Bloomberg's money continues to pour into West Virginia. The former mayor of New York simply cannot stand the idea of people being capable of effective self-defense. Bloomberg is running robo-calls. He is running social media paid ads. He is running targeted media ads on major websites. Cash is flooding into our state from outside, in an effort to trample our right to bear arms.

Senator Joe Manchin, who at this point is little more than a Bloomberg puppet, is stumping around the state trying to convince the Governor to veto SB347.

And then there's the WVCDL. A group of concerned citizens who care about their rights. We are David. We are facing Goliath.

The only way we can win this fight is with activism. We simply must call Governor Tomblin's office today at (304) 558-2000 or 1-888-438-2731.

Then, we need to convince all of our family and friends to call in support of our right to bear arms. The message is simple. "Please ask Governor Tomblin to support my right to defend myself, and sign SB347."

Update: Tomblin vetoed the bill today.

The bill passed with (what would be) a veto proof majority in both houses, so Tomblin waited until there was no opportunity to go back and override it.....:mad:
