What you are missing is that the poster also said he did not have a pistol lower. So he couldn't even make use of the device you showcase. He had lowers with buttstocks and greater than 16" barrels, and was contemplating buying a shorter than 16" barrel/upper only. Every judge in the country would convict in that case.

BTW, this in no way means I agree with the 1934 NFA. In fact, the only case I know of that challenged it in court was the SBS case that was rigged. Any volunteers to challenge it?
