I think the tricky issue that the defense has to worry about is if GZ initiated the contact, why he didn't listen to the operator, and that he was seeking confrontation. I think he is innocent and I don't fault him at all. Hopefully the fact that the state went for the highest charge, it will work to his benefit. I think the state will have a hard time with this.
The really bad part about the judge not allowing the history of TM to be used, is that the uninformed public will still see him as a nice little kid in the white hoodie, getting candy for his brother.
