There is a fine line. Between assault and aggravated assault with intent to do bodily harm.
"IF" what George Zimmerman says and can prove to be true.
Assault - you initiate and get into a fist fight with another person.
Aggravated Assault - you use a weapon during a fight. Aka Pounding another persons head into the pavement.
If George's attorney can prove or show/demonstrate that Trayvon did indead smash Georges head into the pavement, even one time, that is aggravated assault and in defense it is legal IMO to use deadly force. Age and size difference's don't matter in these cases. If it was a 3' tall midget that weighed 65lbs. doesn't matter. Aggravated assault is what it is. There aren't any age, size, sex, or color rules that apply.
As a CHL holder in Texas, if I saw someone getting pounded on the ground and they were smashing someone else's head into the pavement or had another weapon to a person I could take a shot if that was the only way to end the assault.
To me this should be an easy black and white case. (No pun intended)
Either his head was smashed into the pavement or it wasn't. If it was he should be a free man. If it wasn't then yeah, you go to jail.
