One has to ask how an off duty LEO might have responded to a sounding burglary alarm in the neighborhood as well as having unknown individuals on your property? Do you go out with weapon in a holster or weapon at the ready? Do you call dispatch (or 911) first in order to see if there is a police presence?
Remember that this is an upscale neighborhood. Not working class or inner city. And this individual is someone who the masses could identify with, a sympathetic person. If a jury identifies with the defendant then you more likely than not have an acquittal. Thus a political nightmare for the city. Add to that there are several city council seats still being contested in runoff elections.
