Born out of the USA with only one parent as US citizen and without the necessary filing is not a natural-born US citizen. If not formally claimed, the eligibility is lost on reaching the age of majority.

It is actually more complicated than what you (or I, for that matter) have suggested. There are other conditions if only one parent is a US citizen, but those aren't really that common and certainly don't apply in the case of Barry (my daughter is in similar situation, which is why I know about the requirements). IF he was born abroad, they have 18 years to file the Consular Report of Birth Abroad…and they can amend it at any time. Failure to file the Consular Report may create legal complications for proof of citizenship, but they are not insurmountable.
