What do you believe is the purpose of reading Miranda rights? Is it to initiate due process? Or is it to inform a person about their rights against self incrimination?
The Supreme Court has ruled (and is thereby the "Law of the Land" by virtue of the system set up by our Founding Fathers) that in certain time critical cases of public safety, Mirandizing isn't necessary immediately after arrest in order to gain information to protect the public from imminent threats.
Are you saying you disagree with this tact? For nearly 200 years we operated without Miranda warnings, and merely relied on the 5th Amendment to guide the country against self-incrimination.
As I posted previously, there will be plenty of evidence to use against Tsarnaev and prosecutors won't likely even need his testimony in court or any confessions prior to any court proceeding. Any information gained about potential co-conspirators outweighs the worry over self incrimination. Even if a court throws out any self-incriminating information gained prior to Mirandizing him, it would be worth it particularly if they uncover other similar plots in progress. There isn't any talk of torture in order to get this information.
What I find fascinating is this DoJ's decision to delay Mirandizing in light of their refusal to do so in previous terror related arrests and their criticism of "W" for refusing to Mirandize non-citizens at Gitmo.
