The Hague provisions have effectively been rolled up into the Geneva Conventions which are considered to be binding on any country engaged in warfare, so the debates about who signed what are rather academic.
The key phrase is "bullets designed to fragment or expand upon contact". The US position has been that their OTM bullets are not designed to expand (and in fact usually don't), just as the M855 is not designed to fragment - these characteristics are just accidental side-effects.
