If they charge anyone else for possession of a standard capacity freedom magazine, the accused can now point to a case where they refused to prosecute someone else who displayed one on national television. The DA's office then will be in a position where they have to explain why they are picking and choosing where the law will be applied, which is a no-go, as there is no extra-judicial set of laws that govern this type of criminal behavior by elected officials...or at least they're not teaching it in law school.
