I agree it wouldn't pass constitutional muster, but it seems some legislatures simply don't care and will happily pass unlawful bills and wait the decade or two it takes for the judicial branch to sort it out. Other than the eventual loss of their seats, legislators face no other repercussions. Personally, I think such blatant disregard for the Constitution should result in treason charges.
