If I recall, the FPC case didnt emphasize the violation of Article I, Section 9 covering ex post facto laws (unconstitutional).
ATF is trying to act like they never sent determination letters, and just claiming they are enforcing Congresss will regarding the NFA.
Director Dettlebach was very evasive and curated with how he dodged the fact that they issued numerous determination letters since 2012, or the fact that the Biden WH openly ordered ATF to crack down somehow on braced pistols.
This is the same kind of horse manure the Founders were subjected to under English colonial rule, where regional governors were shamelessly ignoring the law and violating the people, especially when it came to their rights to keep and bear arms.
