Sure sounds like murder to me. (And he was not found innocent. The judge declared a mistrial and the DA dropped the charges.)
The problem my friend had was he didn't call his lawyer first. It was never proven he was climbing out the window when he fired, which is one of the many reasons he was not prosecuted by the original DA. There is a lot of information not in the article, but needles to say he was not convicted. My friend was and is going through cancer treatment and is not an aggressive person by any stretch of the imagination. Looking for trouble was not his MO. My friend did not start this conflict, the criminal did. This was a political motivated arrest by a very left leaning DA. As far as I'm concerned any person found in a home, "committing a felony" should be considered a threat and it is not up to the home owner "victim" to know what the intent of the home invader is. Using lethal force is always and I mean always the last resort and my friend would never have used it if he wasn't in fear for his life.
