Decorated Combat Veteran Arrested In New York...AR Magazines BEFORE the NY "law" - Nukes - 02-01-2013 Decorated Combat Veteran Arrested In New York: Charged With 5 Felonies For Possession of AR Magazines In the latest attack on the American people, a decorated War Hero has been arrested and charged with five counts of third degree criminal possession of a weapon, for having empty 30 round AR-15 Magazines in his vehicle. On Sunday January 6th Staff Sgt. Nathan Haddad, a decorated combat veteran, was driving through Jefferson County New York when he was randomly pulled over for a vehicle check. Haddad, who had five 30 round empty magazines in his possession, was arrested by the Jefferson County Sheriffs Department and charged with five felony counts. According to Haddads brother, Michael Haddad, Nathan thought these magazines were legally made before the New York Assault Weapons Ban. When Nathan Haddad was arrested the new ban had not even been fully enacted yet. This is not a criminal, this is not some thug looking to hurt people; this is a decorated combat veteran who was recently honored by the Philadelphia chapter of Blue Star Mothers and the Union Leagues Armed Services Council for helping disabled vets get back on their feet. Whats happening to Army veteran Nate Haddad is an absolute attack on liberty. Here we have a man who honorably served his country, who was trusted with weaponry that far exceeded anything he was carrying, that now finds himself facing the possibility of spending years in prison. Still think these gun control laws are meant to stop criminals? Nathan Haddads brother has set up a legal defense fund for his brother who cannot afford to fight these charges on his own. No link to his 'arrest' or any charges. I brought up the NRA's web site and searched for Haddad and nothing came up. I would imagine that something like this, that supposedly happened close to a month ago, would have hit the NRA's radar screen. Nothing. Yes, this guy was in the Army. How decorated? Don't know. He was not in the Army when he supposedly got arrested. So, what do you think? A scam, maybe? Apparently he was arrested for violating a previous law about magazines over ten rounds but not the current law. The guy violated a law that had been in place since 1994. I edited my comment about it being a lick on him. Instead, it just wasn't his day if he got pulled over at a random search. Unless he got busted for something else and they found the mags. Here is the point. Until these laws are eliminated (and in NYC they won't be), it is best to go around the damn place. Bjorn: Not all things in common use by the military need to be common place for civilians. I am sure that the guy who is holding that kid in his prepper bunker probably didn't need access to things like AT weapons, grenades, claymores, et. al. As for this fellow we are talking about. Apparently he is not in jail anymore but will have a hearing this month. My bet is he will get a fine at most. Unless he got busted for something else and they found the mags in a search. Glad I am no longer in the Army. Went through a couple of iterations of magazines being viewed somewhat like a sensitive item over my career. I imagine the NY ANG and the guys at Drum will probably have to go through a huge process in order to get their magazines for training now that they are illegal in the state. I know -- Federal property. But, that isn't how the Army thinks. Instead it will be secured, inventoried, locked up somewhere, hand receipted out, etc. A lost magazine will mean the unit will stay in the field until they find it. Etc. However, given what has been reported in various "blogs", no ammunition or weapons were found in addition to the magazines, and he doesn't appear to be charged with anything else. As to whether he was randomly pulled over in violation of 4A, or had some traffic law infringement remains to be seen. Regardless, I'd like to see the capacity ban thrown out. I do think there is a chance such bans can be found unconstitutional with the current make-up of SCOTUS... It infers that one will be a "dealer" of firearms and not merely an owner/user. My understanding of US v Miller (1939) was that the court viewed the "tax stamp" as a possible infringement but since SBS were not "in common use" (to their knowledge), it could be regulated. Suppressors and SBRs are "in common use" and I believe should not be regulated (other than thorough background check if you call that regulated). It burns me up that I have to pay the tax, wait for special approval, then expose myself to ridiculous risk by not adhering exactly to NFA requirement on handling, storage, etc. What would a "reserve militia infantryman" be regularly issued?... If the government said we expect the public to at least match the back ground checks and training of law enforcement be fore they can own the same type of firearms as law enforcement personnel then there wouldn't be an argument. If they put very strict punishments on any crimes committed with these firearms there wouldn't be an argument. But has any government representative ever offered these type of policy's? No because they don't care about safety like gun free zones which they consider smart policy yet these same government representatives surround themselves and their family's with armed guards.
